CONTRACT FORMATION
No contract will exist between you and www.baiebrune.com for the sale of products until you receive order confirmation in the form of a receipt detailing your order. Once you receive this confirmation, a legally binding contract will be formed between us. This site is available for your personal, non-commercial use only. The products listed on this site are available in all countries we ship to.
PRODUCT AVAILABILITY .
BAIE BRUNE accepts no responsibility in the event of stock shortage or unavailability of products for orders placed on www.baiebrune.com.
PRICE
The price you pay is the price shown on the website, including VAT for countries within the European Union. The price does not include delivery charges, which are detailed in the "DELIVERY & RETURNS" section. We reserve the right to change prices without prior notice. All orders are subject to availability, and we reserve the right to refuse sales to any individual or company. Prices are quoted in Euros. For sales outside the European Union, customs clearance and the payment of any duties or taxes are the sole responsibility of the customer.
DELIVERY
We will deliver the ordered product(s) to the delivery address you provided. Please verify its accuracy. Any reshipment due to an incorrect address will be at your expense. We do our best to deliver as quickly as possible; however, we are not responsible for delays caused by the Colissimo service. Delivery details on www.baiebrune.com are subject to the conditions explained in the "Shipping" section.
SHIPPING
The prices shown on the website do not include shipping and handling costs. Prices include VAT for customers within the European Union. Orders outside the European Union are exempt from VAT. We reserve the right to change these conditions without prior notice. Shipping is free for all orders (delivered within Metropolitan France) shipped via La Poste's Colissimo service (see details on the website under the "Delivery, Rates and Times" section).
DELIVERY TIME
Orders shipped within France are generally delivered in less than 7 business days after you receive the confirmation email. This is because two bulk shipments are made each week. BAIE BRUNE cannot be held responsible for any additional delays. Delivery times to other countries depend on your local postal service. BAIE BRUNE cannot be held responsible for any misconduct by the postal service.
DELIVERY DELAY / LOST PACKAGE
Colissimo is a very reliable service. However, as with any shipment, there may be a delivery delay or the package may get lost. If your delivery is delayed beyond the date indicated in your shipping confirmation email, please notify us by email. We will then contact the postal service to initiate an investigation. A postal investigation can take up to 21 days from the date it begins. If the package is found during this period, it will be immediately reshipped to your address (this is the case in most instances). If, however, the package is not found after the 21-day investigation period, the postal service considers it lost. Only at this point can we send you a replacement product at our expense. If the ordered product(s) are no longer available at that time, we will refund the amount for the product(s) lost by the carrier.
RETURNS
We want all our customers to be happy with their purchases. You have 15 days from the delivery date to return your item for a refund or exchange. Products eligible for exchange must have been purchased from www.baiebrune.com and must be in their original, unworn condition.
All merchandise returned to BAIE BRUNE (address above) must be returned in the same condition in which it was shipped by us. BAIE BRUNE will inspect all returned merchandise for damage and to verify that it originated from BAIE BRUNE . If the return is due to an error on our part, BAIE BRUNE will reimburse the return shipping costs and resend a replacement product at no cost to the customer – OR – refund the price of the product plus all shipping costs. For full details on return procedures, please refer to the Exchanges and Returns section of our website.
EXCHANGES
As part of exercising the right of withdrawal, products must be returned in their original packaging with associated elements, in their original condition, new, unworn, unwashed and accompanied by their purchase invoice or a copy in the case of a partial return, within 15 days .
Returning a product for a refund is free if the delivery address is in mainland France. If the delivery address is outside mainland France, you are responsible for the return shipping costs and risk.
To do so, you must send an email to info@baiebrune.com explaining why you wish to return your order. Within one week, you will receive a return label by email to send back your order, as well as a prepaid shipping label (BAIE BRUNE will cover the return shipping costs if your delivery address is in mainland France), which you will need to print.
If the order return slip is not included in the package, BAIE BRUNE will not be able to process the refund for the returned products.
Products found to be incomplete, damaged, worn or soiled will not be refunded.
REFUND
In the event of a refund request, it will be processed within a maximum of fifteen (15) days from the date BAIE BRUNE receives the product(s). Once the products have been received, inspected, and accepted by our team, the refund, including the standard delivery charges for the initial order, will be issued using the same payment method used for the original order.
Please note, however, that your bank may apply an additional delay when processing the refund.

Please note that no statement made by any agent of www.baiebrune.com shall be construed as a variation of these terms and conditions , nor shall www.baiebrune.com be liable to anyone for any inaccuracies in such statements.
APPLICABLE LAW
Any contract between us shall be interpreted and deemed to be in accordance with French law and any dispute arising out of or relating to this contract shall be subject to the exclusive jurisdiction of the French courts.
